It’s not a smoking gun but a smoking cigarette that has a northeast Iowa mantaking the city of Hazelton to court. 58-year-old Fred Kitterer spent 30 dollars to send someone else to the CityHall to pick up a permit. Kitterer says he sent someone else to do the jobbecause he didn’t want to breathe second-hand smoke in the City Clerk’soffice. Kitterer, who’s a sign painter, has gone to small claims courtasking the city to reimburse him for the 30 bucks because he couldn’tconduct business with the city in a smoke-free environment.
