The Iowa Court of Appeals has upheld a conviction appealed because officers searched household garbage without a warrant. Authorities went through the suspect’s trash after a tip from an informant, and what they found in the garbage was enough to get a warrant to search the Johnson County house. They arrested its occupant and he was convicted of theft and possession of marijuana with intent to distribute. The Appeals court says the fourth amendment and previous court rulings support its finding that trash can be searched without a warrant to get evidence.
