A former high school athlete is told gravel poses no greater risk to his athletic exploits. Shawn Murtha sued the H-L-V School District for an incident that happened in 1997. He was running on a gravel road during track practice and injured his foot. Murtha argued the school district was putting him at an “unreasonably high risk of injury” by forcing him to do endurance practice on a gravel road. The Iowa Court of Appeals says Murtha admitted he knew twisting his ankle was a risk of the sport and the Appeals Court upheld a lower court’s decision to dismiss the lawsuit.
