A central Iowa man has failed to convince a panel of judges he shouldn’t have been arrested for drunk driving because he wasn’t driving. Here’s what happened: Gregory Alan Clevenger was sitting in the driver’s seat of his car in a parking lot in Indianola when a cop came along and asked him to get out. Clevenger admitted he had been drinking and that he’d driven the car to the parking lot and planned to drive friends home. He failed a breath test and was arrested for drunk driving. Clevenger appealed his conviction because he said the cop didn’t have reasonable grounds to make the arrest because he wasn’t actually driving when the officer caught up with him.
