The State Supreme Court has ruled Iowa’s grandparent visitation law is unconstitutional.Grandparents Joe and Lois Santi of Des Moines sued to get court-ordered visitation with their grandchild, who lives in Des Moines, too. The toddler’s parents, though, filed a counter suit, challenging the Iowa law which set up the legal process for grandparents to go to court to get visitation rights. The Iowa Supreme Court ruled there’s no compelling interest in having the state be involved in fostering close relations between grandparents and grandchildren if the parents object. The justices said court-ordered visitation over the objection of parents was unconstitutional “state intrusion” on childrearing.
