An employer won a point but lost a case before the Iowa Court of Appeals this week.The worker says he’s got the shakes, aches, pains, and physical ailments, after two firearms incidents in six days at a convenience store where he worked in 1994. The man says an argument turned into a shooting while he worked the night shift, and he had to clean up blood from an injured woman, and later testify in her court case. Less than a week later, a man claiming to have a gun robbed the store, then ran back in to say he was going to shoot the terrified clerk in the head. The Appeals Court says it’s true that in claiming a case of post-traumatic Stress Syndrome, a lot of workers would have to prove their stress was worse than that suffered by an average employee in the same job, but said this employee doesn’t have to prove it’d be more than daily stress to witness a shooting and be threatened with having his brains blown out.
