The Iowa Court of Appeals has ruled against a man who sued over his fried chicken.The one thing not in dispute is that Donnie Burgmaier bit into a piece of chicken and cracked a tooth. After his case was thrown out, Burgmaier appealed, saying it might have been something besides a bone he bit, but the panel said that’s not an issue he raised when he first sued. The Appeals Court ruled that Burgmaier didn’t show he’d tried to settle his case with Kentucky Fried Chicken before taking it to the courts, and said under the law describing makers versus sellers of a product, K-F-C was probably not the “manufacturer” of the chicken breast in question. And the court ruled there’s a common-sense requirement to watch out for the bones when you know there are some in your meal.
