The Decorah City council won’t appeal the Iowa Appeals Court ruling that struck down their decision to let WalMart build a new store in a flood plain. The council voted unanimously to not appeal the ruling, saying it would save time and money. The case would now go back to the district court. Some Decorah residents filed the suit against the city and WalMart claiming the construction at the store site would contribute to flooding — and damage their property. A settlement could be reached if WalMart would pay into a fund to help defray any cost brought on by flooding linked to the store. The construction on the store continues and it is scheduled to open in October.
