Officials who evicted assisted living center residents judged unfit to care for themselves have agreed to a temporary change in the rules. Under Iowa law, a state inspector may order a resident of an assisted living center into a nursing home if they believe the patient’s too ill to live in the assisted living setting. Legislators intervened, though, when they fielded complaints about such evictions, and now lawmakers have proposed an appeal process.Republican Representative Clyde Bradley of Camanche says the Department of Inspections of Appeals has agreed to abide by the proposed rules, which Bradley says legislators will enact in January. Bradley says moving is sometimes the wrong answer for an elderly person.Those who appeal state-ordered eviction from an assisted living facility will have their case reviewed by a committee made up of their doctor, their family, a licensed social worker, and a staff member from the assisted living facility.
