Lawyers are making oral arguments today (Thursday) in Saint Paul, Minnesota, before a three-judge panel of the eighth U.S. Circuit Court of Appeals in the case of the closed Meskwaki Casino in Tama. Back in May, U.S. District Judge Linda Reed decided to enforce an order from the National Indian Gaming Commission closing the casino due to the tribal leadership dispute. Both sides in that battle want to see the casino reopened. Attorneys for the elected council say Judge Reed “overreacted” by enforcing the order. The appointed council says that because of the closure, their property rights have been violated without due process. The court of appeals cannot decide if the casino will reopen — it can only decide whether Judge Reed’s decision should be overturned.
