The Iowa Supreme Court has waded into a dispute involving a couple from Sibley, the Sibley City Council and the owners of a cement plant. Kenneth and Myrna Harris of Sibley filed a lawsuit. They said the home they’ve lived in for 40 years had become unlivable because of the dust, noise and traffic from Joe’s Ready Mix plant that opened across the street in late 2001. They argued the City of Sibley didn’t have the authority to rezone their neighborhood, which paved the way for the cement plant to locate there. A district court awarded the couple almost 74-thousand dollars for the loss in property value caused by the plant, and ordered the city of Sibley and the plant’s owners to pay up. But the state’s highest court has ruled the City of Sibley had the authority to rezone the couple’s neighborhood, which led to the Ready Mix plant moving in. The Iowa Supreme Court has ruled Joe’s Ready Mix and the owner of the property have created a nuisance and should pay all of that money to the couple.
