A Des Moines man who was found guilty in connection with the deaths of his two young nephews has lost most of his bid to shed his convictions. Richard Allen Milsap, Senior, was convicted of two counts of child endangerment, one count of driving while barred and two counts of homicide by vehicle. Milsap’s two nephews — the boys were 9 and 10 years old — were helping him clean brush and tree limbs in September of 2002. The boys were riding in the back of his pickup with the rubbish when they fell out and were killed. Milsap appealed his convictions, arguing lots of parents let children ride in the back of their trucks and they aren’t charged with child endangerment. The court’s justices, though, said there was ample evidence with that having the kids on top of the limbs, with panels on only two sides of the truck bed, was dangerous. But the court said it was wrong for a lower court to sentence Milsap to more prison time for the driver’s license violation. Milsap did not appeal his homicide by vehicle convictions.
