A woman seeking money from Prairie Meadows because a drunk gambler wound up driving his vehicle into the casino, and hitting her, has lost another round in court. It happened back in October of 2002. Douglas Kinney drove his vehicle into the Altoona casino’s south entrance, hitting and injuring Sandra Veach and another person.

Tests show Kinney’s blood alcohol level was over the legal limit at the time of the crash. Surveillance video showed Kinney had been drinking inside the casino. But a district court judge rejected Veach’s request for damages from Prairie Meadows for serving the driver alcohol because the proper paperwork had not been filed within six months of her injury. The Court of Appeals has agreed she failed to meet the deadline for filing the paperwork.
