The Iowa Court of Appeals has upheld the convictions against a man who drove his S-U-V into an Iowa casino. It happened nearly five years ago. Officials say Douglas Kinney was drunk when he drove his Chevy Tahoe — at about 45 miles an hour — through the front doors of Prairie Meadows.

Two people were seriously injured. A judge found Kinney guilty of two counts of willful injury and one count of criminal mischief. He was sentenced to up to 10 years in prison.

Kinney’s convictions have already been upheld. Kinney’s appealed again, trying to get a lighter sentence, arguing his lawyer failed to adequately pursue the "he was too drunk to know what he was doing" defense.

The Court of Appeals has rejected Kinney’s complaint and upheld his sentence.
