The parents of a Mason City teen who died in an accident last fall have filed a lawsuit. Brenda and Dale Schmidtke are suing the driver of the vehicle and his parents as well as the driver of another vehicle they say was in a race with the car that their son was in.
Sixteen-year-old Colby Schmidtke died on October 27th after being injured in an accident that sent the car he was in into the Winnebago River. The Schmidkes claim the driver of the vehicle their son was in, 17-year-old Dustin McMurray, was driving in a negligent manner, causing the crash.
The Schmidtkes are also claiming that Drew Locasio was traveling at a high rate of speed in a race-chase situation with McMurray at the time of the accident. The Schmidtkes also claim that McMurray’s parents were negligent because he was operating their car without their consent.
The Schmidtkes are seeking an unspecified amount of damages in a jury trial.
