Police car lightsCharges are now filed against a driver involved in an accident near Duncombe last Christmas Day that killed a Webster City girl.

Twenty-one-year-old Ruth Tomlinson of Duncombe is charged with driving on the wrong side of the roadway, failure to maintain control of a vehicle and failure to provide proof of financial liability.

The Iowa State Patrol reported that Tomlinson was traveling east when she drifted across the center lane and struck a westbound truck driven by Justin Henry of Webster City. Henry and his passengers Brooke Ford, Hayley Henry, Rowyn Henry and Payton Henry were transported to a Fort Dodge hospital for treatment of their injuries. Payton was later transported to Blank Children’s Hospital in Des Moines where she died of her injuries on December 26, 2015.

Tomlinson is scheduled to make an appearance in Webster County Magistrate Court in Fort Dodge on Friday.
