The Iowa Supreme Court has thrown out the pot conviction of a Black Hawk County man who claimed it was hers, not his. Ross Cashen was convicted of marijuana possession. Cashen was in the backseat, with his girlfriend on his lap when cops pulled over the car they and four others were riding in. Cops found a lighter and Zig-Zag cigarette papers on Cashen. His girlfriend had rolling papers and marijuana seeds in her pants. A baggie of marijuana was wedged in the rear seat where Cashen and his girl were sitting. Cashen’s girlfriend admitted the pot was hers, but cops still charged him with possession, and a jury found him guilty. The Iowa Supreme Court has ruled that regardless of the suspicions raised by his proximity to the pot, there was insufficient evidence to convict Cashen for marijuana possession.
