Senator Tom Harkin is not on the Senate Judiciary Committee that’s been holding confirmation hearings on Supreme Court nominee John Roberts, but the Iowa democrat says he has been watching and reading about the hearings. “You know, the guy seems to be quite smart and well spoken and he knows how to hedge his answers, no doubt about that. I was pleasantly surprised and relieved to hear him say that there is within Constitution a right of privacy. This is uh, this is very interesting,” Harkin says. He says Roberts statement on privacy is surprising based on what’s been said about the judge leading up to the hearings.He says for someone who’s supposed to be a strict constructionist, the right of privacy, which Harkin says he also believes is inherent in the Constitution but is not said there anywhere in the Constitution, just goes to show that ,”Judges do make law. They interpret it in a way that changes how we approach things in our society.” Harkin will vote on the Roberts nomination along with the full Senate if the Judiciary Committee votes to move the nomination forward.
