A Clarinda man accused in a kind of road rage incident has lost his bid to overturn his conviction. Clarinda cops say on March 19th of last year, Daniel Newberg shot BB’s at two big, loud trucks that were driving by his apartment — one of the shots shattered the rear window of one of the trucks.

A judge found him guilty of intimidation with a dangerous weapon and third-degree criminal mischief. Newberg appealed, arguing there wasn’t sufficient evidence to support either conviction.

The court of appeals has ruled there was “ample” evidence to convict Newberg and pointed out Newberg had modified the window in his apartment that faced the street so he could quickly remove the screen — making it easier to shoot his gun through it.
