The attorney for a western Iowa man convicted of sexually exploiting his teenage daughter wants a new trial for his client. Less than ten days after a federal jury handed down a guilty verdict in the Brian Street child pornography and exploitation case, Street’s attorney Chad Primmer is asking a judge to overturn his client’s conviction or grant him a new trial.

Primmer says there were errors in the pre-trial and trial motions, as well as instructions to the jury. The 39-year-old Griswold man was convicted January 10th of taking pornographic pictures of his 17-year old stepdaughter, Tracey Dyess. Primmer says Dyess was a willing partner in the sexual activity. Dyess set fire to her family’s home in March of 2005 in an attempt to kill Street for years of sexual abuse. Street escaped, but Tracey’s 13-year-old sister and six-year-old nephew died in the blaze.

Dyess, who is now 19, is currently serving a 45-year prison sentence on voluntary manslaughter charges in connection with the children’s deaths. She will be eligible for parole in 17 and a-half years.
