State and local officials are investigating a fatal shooting of a Worthington, Minnesota man in Spirit Lake Sunday. Fifty-three-year-old Marlin Ray Lutterman was apparently riding his motorcycle through Spirit Lake and had parked it on the west side of the Spirit Lake downtown area.

Terry Klooster is a state agent with the Division of Criminal Investigation. "Mr. Lutterman and at least two others on motorcyles parked there in Spirit Lake and were in the process of getting off their motorcycles when Mr. Lutterman was apparently struck by a bullet," Klooster says.

Lutterman was treated at the scene and taken to the hospital, where he later died. Agent Klooster says authorities quickly determined where the shot came from. "Right now, it appears it came out of an apartment building in the Spirit Lake downtown," Klooster says. Fifty-five-year-old Kenneth George Neilson Junior, of Spirit Lake is in custody.

Authorities believe Neilson was shooting a gun from apartments that are just a few hundred feet north of where Lutterman was shot. Police are not saying whether the shooting was an accident or whether the two men knew each other. Neilson has been charged with reckless use of a firearm.
