Investigators say a locksmith shot and killed a former tenant of the Bon Jour Apartments in Dyersville on Saturday. Dubuque County Attorneys are not identifying the gunman or saying why he is not facing charges. Sheriff’s Captain Bob Lynn says the maintenance man shot 24-year-old David Herman after Herman was evicted and the man was working to change the locks.

Lynn said, "The main question involving the whole case is, was this individual justified in using the force that he chose to use to protect himself?" The maintenance man claims he acted in self-defense and officials say he had a permit to carry a concealed weapon. Herman’s friend and neighbor, Curtis Savage, says he finds it hard to believe that Herman deserved to be shot.

"David was the kind of guy who would give you the shirt off your back. I have never seen him in a mean state," Savage said. He claims the shooting has frightened everyone in the neighborhood. "We fear for our safety because we don’t know whose coming into our house," Savage said. "With what type of work it’s suppose to be one of those maintenance people and he is carrying a gun."

Deputies say the locksmith shot Herman in the chest, after Herman followed him to his car. Savage admits he doesn’t know all the details, but says to him it seems the locksmith aimed to kill. Dubuque County Attorney Ralph Potter met with investigators Monday, but has not offered any comments on the case.
