Lawsuit accuses Georgia company of overcharging for medical records

A class-action lawsuit against a Georgia-based medical records company could involve thousands of Iowans. Des Moines attorney, James Bisconglia, says the lawsuit filed against HealthPort Technologies for overcharging. “Regardless of whether or not you request one page or five pages, they regularly charge 20 dollars,” Bisconglia says.

He says the company is not supposed to charge a blanket fee for any records request. “The amount that is to be charged, is supposed to be based on the actually cost of reproduction,” Bisconglia explains. Bisconglia alleges HealthPort also charges a delivery fee, which is also illegal in Iowa.

The lawsuit represents residents of Polk, Marshall and Warren counties, though more plaintiffs may follow. Iowa is one of several states in which class-action suits have been filled against HealthPort in regards to overcharging for records requests. Bisconglia works for the LaMarca & Landry law firm.
