Appeals court orders new trial for Northwest Iowa man convicted of child abuse

GavelThe Iowa Court of Appeals has ordered a new trial for a 33-year-old man from Sheldon who was convicted of injuring his girlfriend’s three-year-old daughter.

The appeals court concluded a lower court judge erred by letting Joseph Bailey’s girlfriend testify that it was her opinion that Bailey “did it” and was guilty of child endangerment causing serious injury.

The toddler suffered two broken arms and a brain injury and a doctor concluded the injuries were not accidental.

Bailey is to get a new trial on the same charges.
