Another group of legislators is wading into the controversy over assisted living centers. State inspectors have come under fire for ordering frail elderly out of assisted living facilities and into nursing homes. Republican Representative Willard Jenkins of Waterloo, chairman of the Legislature’s Oversight Committee, says the panel’s getting involved because state law needs to be clarified about which patients can and cannot live in an assisted living setting.At the urging of the Legislature’s Administrative Rules Committee, state inspectors recently agreed to let assisted living residents appeal evictions, although there’s no appeals process outlined in state law. Jenkins says in January, legislators will make it law.Jenkins envisions a formal meeting of three groups — the patient’s family, the doctor and a state official — to discuss each ordered eviction.
