An Oskaloosa man convicted of abusing his girlfriend’s two-year-old son will get a new trial. The judge says lawyers for 23-year-old Clarence Yoe should have been able to accuse his girlfriend of being an accomplice, and the jury received incorrect instructions. Yoe was found guilty in December of physically abusing two-year-old Frank Charbonneau, Junior. The toddler’s 21-year-old mother, Miranda, pled guilty to allowing the abuse. In a ruling issued yesterday, Judge Richard Vogel said there is “overwhelming” medical evidence that the two-year-old was abused on several occasions, but the evidence doesn’t indicate who inflicted the injuries.
