A state appeals court has ordered a robbery conviction against a Scott County man dropped citing a lack of evidence. Police say James Heard entered a Davenport convenience store in May of 1999 wearing a bag on his head, thick safety glasses and socks on his hands as a disguise. Heard fled the store with cash. Heard was convicted of second-degree robbery. Evidence presented in the appeal said Heard didn’t verbally or physically threaten the store clerk and did not display a weapon, so the robbery conviction could not stand. The court agreed with the argument.
