Iowa Supreme Court will hear Gay marriage case

February 4, 2004 By admin

The Iowa Supreme Court has waded into another hot topic and has agreed to begin hearing the case brought by legislators who want the Court to overturn a gay divorce. In November, a judge in Woodbury County granted the dissolution of a Vermont marriage that ended up being between two women. The judge later amended that ruling to a property settlement. The Iowa Supreme Court yesterday told folks on both sides of the dispute to file briefs outlining their beliefs. Senator Neal Schuerer, a republican from Amana, is one of the legislators pursuing the case.Schuerer says that judge had no legal standing to issue the lesbian divorce because Iowa law only recognizes marriage as between a man and a woman. Schuerer says he hopes the Iowa Supreme Court eventually determines the judge acted inappropriately and disciplines him.
