Court overturns Le Mars man’s drug conviction

July 25, 2007 By admin

A northwest Iowa got his drug conviction dismissed by the Iowa Court of Appeals. Randall Mosher of Le Mars argued there wasn’t enough evidence to convict him of marijuana possession. It all stems from a search of the home Mosher was renting.

Police found several bags of marijuana and another man who was Mosher’s roommate told cops it belonged to him. Mosher admitted he had smoked pot with his roommate, but also maintained the marijuana wasn’t his. A judge, however, found Mosher guilty of possession of marijuana.

The Iowa Court of Appeals has ruled the evidence in the case is insufficient to support his conviction, so the appeals court dismissed it.
